131  Confiscation or penalty not to interfere with other punishments

 

Confiscation or penalty not to interfere with other punishments, Section 131 of CGST Act, 2017131. Without prejudice to the provisions contained in the Code of Criminal Procedure,

1973, no confiscation made or penalty imposed under the provisions of this Act or the rules

made thereunder shall prevent the infliction of any other punishment to which the person

affected thereby is liable under the provisions of this Act or under any other law for the time

being in force.

malaika: Sir, pls can you guide me that if my client has been served with a order with a payment of penalty under sections 111D, 111I, 111J, 1111L, 111M, 111O of the customs act which he is ready to pay to release the confiscated goods, what can i do to procure the same?

lychan: I hope you can tell me why my shipment from Malaysia to my son who is working in Solomon Island has status ‘import terminated ‘ in Australia.There are altogether 4 packages sent at d same time with weight from 3 kg,5 kg,7.45kg and 3.6kg. They contain baby stuff like diapers,apparel,rocker,potty trainer,musical toy,etc meant as gifts for my newborn grand daughter there. All the packages are sent by airfreight through my local post office. After more than two weeks of sending, I tracked d status of all four shipments and saw the same message,import terminated in Australia. I do not understand why the packages are confiscated and also why in Australia when these are bound for Solomon Island. I would really appreciate your explanation on this matter so that in future I know how to go about sending gifts for my grandchild.
